Tax agent obligations.

TPB and Code requirements effective 1 July 2025 · Information last updated 31 July 2025

JKA Services Pty Ltd t/a Malanos and Co is a registered tax agent with the Tax Practitioners Board (the TPB). All registered tax agents and BAS agents must comply with the Tax Agent Services Act 2009, which requires us to inform current and prospective clients of the following matters.

The TPB register

The TPB registers and regulates tax practitioners under the Tax Agent Services Act 2009. A public register lists all registered agents, including any whose registration has been suspended. You can search the register by practitioner name or registration number at www.tpb.gov.au/public-register. Guidance on using the register is available at www.tpb.gov.au/help-using-tpb-register.

Making a complaint

If you have any concerns about our services, please contact Peter Malanos on 07 3256 0822. We take every concern seriously and will work with you to resolve it.

The TPB also accepts complaints about tax practitioners via its online form at myprofile.tpb.gov.au/complaints, with further information at www.tpb.gov.au/complaints.

Rights, responsibilities and obligations

The Tax Agent Services Act 2009 includes the Code of Professional Conduct, which sets out the professional and ethical standards registered tax practitioners must comply with. Our obligations include:

  • Acting lawfully and in our clients' best interests
  • Acting with honesty and integrity
  • Managing conflicts of interest
  • Taking reasonable care to ensure tax laws are applied correctly
  • Providing services competently and in a timely manner

As a client, you also have obligations, including:

  • Providing complete and truthful information
  • Keeping the records required by law
  • Advising us of any relevant changes to your circumstances
  • Cooperating with our reasonable requests
  • Meeting your lodgment and payment deadlines

Prescribed events within the last five years

Tax practitioners must disclose whether, within the last five years (in respect of events occurring after 1 July 2022), they have experienced any prescribed events, including suspension or termination of registration, bankruptcy, conviction of a serious taxation offence or an offence involving fraud or dishonesty, imprisonment of six months or more, penalties or injunctions relating to tax exploitation schemes, or Federal Court pecuniary penalties under the Tax Agent Services Act 2009.

Malanos + Co advises that none of these events have occurred.

Conditions of registration

Tax practitioners must also disclose any conditions imposed on their registration by the TPB that limit the scope of services they may provide.
